PT Applicant Convicted of a Misdemeanor DUI Granted Full License – Statement of Issues Withdrawn

Our office represented someone who had recently applied for their license with the Physical Therapy Board of California. Unfortunately, during their schooling, they were convicted of a DUI, and the Board denied their license based upon that conviction. After many years of school, and tens of thousands of dollars in tuition, our client was understandably devastated. 

Although the denial had already occurred, we encouraged the applicant to pursue a Penal Code Section 1203.4 Expungement anyways. After the Statement of Issues was filed by the Board, we provided significant mitigation including the PC 1203.4 Dismissal Order to the Board and argued that the Board no longer had jurisdiction to deny the license based upon a dismissed/expunged conviction. After significant communications with the Deputy Attorney General assigned to the case, the Board agreed to dismiss the matter and grant the applicant a full PT license.
