Our office recently represented a medical physician following a misdemeanor criminal conviction. The physician disclosed their conviction to the Board, and participated in the Board’s investigatory process. Unfortunately, the matter was assigned to a prosecutor who was fixated on an excessive term of probation, with terms and conditions that would render them unemployable, despite significant mitigation, including forensic evaluations, letters from their therapist, declarations of support from their employers, and extensive ethics programing.
After a multi-day hearing, the Office of Administrative Hearings found that the most appropriate level of discipline was a Letter of Public Reprimand and the Board adopted the proposed decision.
